1. Agreement

These Terms are a contract between you and BADATAI, Inc., a Colorado corporation ("BADATAI", "we", "us"). They govern your use of yourpromptssuck.com and any related services ("YPS", "the Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy is incorporated into these Terms by reference.

2. Eligibility

You must be at least 18 years old to use the Service.

If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Your account

You are responsible for your account credentials and for everything that happens under your account. Notify us immediately at jerry@infinite-bit.com if you believe your account has been accessed without your authorisation.

You may close your account at any time. See the Privacy Policy for what happens to your data when you do.

4. What the Service does, and what it doesn't

YPS runs deterministic checks against the text you submit and reports what they counted. It also generates commentary and a rewritten version of your text using a language model.

The checks report facts about your text. They do not guarantee predictions on whether a model will respond well to it, and we don't claim they do. We don't control the models — their behaviour changes between versions — and we re-run our tests against current models as they change.

The rewritten version is model output. Review it before you use it.

5. Your content

You keep your content. You retain all rights in the text, prompts, and files you submit ("Your Content"). We claim no ownership of it.

You grant us a licence to run the Service. You grant BADATAI a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and process Your Content solely for the purpose of providing the Service to you. This licence ends when you delete the content or close your account, except for copies already held by subprocessors under their own retention schedules and copies in backups until those age out.

We do not use Your Content to train models. We do not train models.

You are responsible for what you submit. You represent that you have the right to submit Your Content and that doing so does not violate any law or any third party's rights. Do not submit content you are not permitted to share.

6. Output

Subject to these Terms, BADATAI assigns to you whatever rights it may have in the text the Service returns to you in response to Your Content ("Output").

Two things you should understand about Output:

• Output may not be unique. Other users submitting similar text may receive similar Output. We make no claim that Output is original to you.
• Copyright in AI-generated material is unsettled. We make no representation that Output is protectable, or that it does not resemble existing material. You are responsible for reviewing Output before you use it.

7. Acceptable use

Do not use the Service to:

• Break the law, or facilitate anyone else breaking it
• Submit content you do not have the right to submit
• Attempt to gain unauthorised access to the Service, other accounts, or the systems behind them
• Probe, scan, or test the vulnerability of the Service without our written permission
• Interfere with the Service, overload it, or evade any rate limit, quota, or access control
• Scrape, spider, or extract data from the Service by automated means, except through an interface we provide for that purpose
• Resell or redistribute the Service
• Use the Service to build or train a competing product
• Submit content designed to make the underlying model produce material that violates the model provider's usage policies

We may suspend or terminate your access if you do any of these.

You are also bound by our model provider's policies. Your use of the Service must comply with Anthropic's Usage Policy, since your text is processed through their API.

8. Availability

The Service is provided as-is and we make no commitment about uptime, availability, or continuity. We may change, suspend, or discontinue any part of it at any time.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, BADATAI disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that its analysis or Output will be accurate or reliable.

10. Limitation of liability

To the fullest extent permitted by law:

BADATAI will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to your use of the Service, even if we have been advised of the possibility.

BADATAI's total liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) one hundred United States dollars ($100).

Some jurisdictions do not allow these limitations, in which case they apply to the maximum extent permitted.

11. Indemnification

You will defend, indemnify, and hold harmless BADATAI, Inc. and its officers, directors, and employees from any claim, demand, loss, or expense (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms.

12. Termination

You may stop using the Service and close your account at any time.

We may suspend or terminate your access at any time, with or without notice, if you breach these Terms or if we discontinue the Service.

Sections 5 (as to the licence surviving in backups), 6, 9, 10, 11, 13, and 14 survive termination.

13. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules.

Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Adams County, Colorado, and you consent to the jurisdiction of those courts.

If you are a consumer in the EEA or UK, nothing in this section deprives you of the protection of mandatory provisions of the law of your country of residence.

14. General

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and BADATAI regarding the Service.

Severability. If any provision is held unenforceable, the rest remains in effect.

No waiver. Our failure to enforce a provision is not a waiver of it.

Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.

Changes. We may modify these Terms. We will post the updated version here and update the "last updated" date. Material changes take effect 30 days after posting. Continuing to use the Service after that means you accept them.
